General Terms and Conditions (GTC)

1. Scope of Application and Provider

  1. These General Terms and Conditions (“Terms”) apply to the use of the website spatar.de, including the blog at spatar.de/blog, and to all purchases made via the online store shop.spatar.de (collectively, the “Website”).

  1. Deviating or conflicting terms of the user shall not apply unless we have expressly agreed to them in writing.

2. Definitions

  1. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (Section 13 German Civil Code – BGB).
  2. A business customer is any natural or legal person or partnership acting in the exercise of their commercial or self-employed professional activity (Section 14 BGB).

3. Subject Matter of the Website

  1. The Website provides editorial content, blog articles, and information related to the Spatar String Art project.
  2. The online store offers physical DIY string art kits for purchase.
  3. The Website does not provide legally binding advice or guarantees beyond statutory obligations.

4. Conclusion of Contract (Online Store)

  1. The presentation of products in the online store does not constitute a legally binding offer, but an invitation to place an order.
  2. By completing the checkout process, the customer submits a binding offer to purchase the selected products.
  3. A purchase contract is concluded only when we accept the order by:
    • order confirmation email, or
    • dispatch of the goods.
  4. The contract language is English.
  5. The contract text is stored by us but is no longer accessible to the customer after completion. Order details are provided by email.
  6. Before submitting the order, customers can review and correct input errors using the standard browser and checkout functions.

5. Prices and Payment

  1. All prices are stated in EUR and include statutory VAT, unless stated otherwise.
  2. Shipping costs are shown separately during checkout.
  3. Payment methods available may include:

    • Mastercard

    • PayPal
    • Klarna
    • Other methods shown at checkout
  4. Payments are processed via Shopify and its integrated payment providers.

6. Delivery and Availability

  1. Delivery is made to the address provided by the customer.
  2. Delivery times are stated during checkout and are non-binding unless expressly agreed otherwise.
  3. If a product is unavailable, we will inform the customer without undue delay.

7. Right of Withdrawal (Consumers)

Consumers within the European Union have a statutory right of withdrawal of 14 days.

8. Statutory Warranty (Mängelhaftung)

The statutory warranty rights under German law apply.
No limitation or exclusion of consumer warranty rights is made.

  1. Certain features (e.g. comments) may require user input or registration.
  2. Users are responsible for all content they submit.
  3. We reserve the right to moderate, edit, or remove comments or user-generated content at our discretion, in particular if content:
    • violates laws or third-party rights
    • is offensive, misleading, or abusive
    • contains advertising or spam

10. Intellectual Property

  1. All content on the Website (texts, images, designs, logos, videos, software) is protected by copyright and intellectual property laws.
  2. Use of content is permitted only for private, non-commercial purposes, unless expressly agreed otherwise.

11. Prohibited Use

We reserve the right to amend these Terms at any time.

The version published on the Website at the time of use shall apply.

16. Governing Law and Jurisdiction

  1. These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. If the user is a consumer residing in the EU, mandatory consumer protection laws of their country of residence remain unaffected.
  3. For business customers, the place of jurisdiction is Munich, Germany.

17. Online Dispute Resolution / Consumer Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).

18. Severability Clause

If any provision of these Terms is or becomes invalid, the remaining provisions shall remain unaffected.
